Below are the basic terms and conditions for any projects created by The Marketing Company. Terms can also be stipulated in our proposals. By accepting our proposal you automatically accept the Terms & Conditions.
  • Proposals are free of charge and you are under no obligation until the proposal is accepted by you (written acceptance via email).
  • Proposals are valid for 30 days from the date on the proposal, unless stated differently on the proposal.
  • Prices on estimates are not binding.
  • A deposit of up to 50% is required for Web design. A project will only start after the proposal is accepted and the deposit paid.
  • All information to be included in any web design must be provided by the client. If you need The Marketing Company to assist with creating content, copywriting or editing copy you will be billed ad hoc at an hourly rate or quoted separately.
  • Information (word/text), as well as images, logos and artwork (or photographs) to be used, must be electronically supplied unless they are to be created as part of the project. If images need to be sourced the images will be at the client’s expense and are not included in our fee.
  • We allow for certain design changes. Any additional work or ad hoc changes and updates will be charged at an hourly rate (dependent on task, to be verified at the start of task) or will be quoted separately.
  • Changes must be requested in writing (email).
  • Please ensure you have the copyright for all material supplied. Under no circumstances will The Marketing Company be held responsible for any copyright disputes.
  • If it becomes clear that material was provided without the required copyright, changes to a project (to remove illegal content) will be at the client’s cost. The Marketing Company does not take any responsibility for content supplied without proper copyright whatsoever.
  • The Date of Completion (DOC) of a project is affected by feedback and receiving of content and timelines will be adjusted accordingly.
  • We cannot be held responsible for delays outside of our control, e.g. equipment failure, weather.
  • We have the right to use any blog articles, content created and designed in promotional material and for other purposes anywhere else for The Marketing Company.
  • Ongoing Monthly work (e.g. Website Maintenance/Online Marketing, etc.) will be billed for monthly and is payable in advance and within 7 days of invoice date.
  • Late payments will incur a penalty fee of R250 for invoices less than R10 000, and 2% on the full amount for invoices above R10 000.
  • If a project is cancelled at any time, all fees up to that point of work will be calculated and invoiced. This is payable within 7 days of invoice date.
  • On termination of a monthly online marketing contract, or a monthly website maintenance package, an exit fee will be charged, equivalent to the monthly fee. This exit fee does not include any further service unless arranged by prior agreement.
  • All work remains the property of The Marketing Company until final payment is received.
  • Proposals do not include domain name registration or hosting.
  • Content must be supplied electronically, within 1 month of the start of the project. If the client is not forthcoming we retain the right to create the necessary content to finish the project. The client will be billed for our time and we will not be held responsible for any information that is not entirely accurate.
  • A project will only be released once it has been proofed and accepted by the client. Therefore we take no responsibility for website/newsletters, etc. content errors.
  • We endeavour to make websites that perform well in current major browsers, but cannot guarantee backwards compatibility.
  • If you use a service provider on our recommendation, you will enter into an agreement directly with them. The Marketing Company will not be held responsible for their service or lack of.
  • Authorisation – The CLIENT authorises The Marketing Company to perform services on the CLIENTS’ behalf, which may include, but is not limited to, registering their domain, accessing their hosting account and disk space, creating databases and applications, managing their online advertising, and submitting their project to search engines.
  • The Marketing Company does not do the hosting etc and does not have control over the status of hosting, domain renewals or email. All technical aspects of websites must be referred to your service provider. We will, however, request feedback from your provider via email if you need assistance. This time may be billed.
  • Costs and Fees – Changes and additions to our fees will be quoted and invoiced to the CLIENT. The CLIENT will be advised of all costs, changes and additions. Any monthly packages or agreements are subject to change, but the CLIENT will be given reasonable notice.
  • Payment – The CLIENT agrees to pay The Marketing Company in accordance with the terms specified in each proposal/estimate. Payment is due within 7 days from the date of Invoice. If the CLIENT fails to pay any invoice, The Marketing Company reserves the right to withdraw the website and associated materials or refuse completion and/or delivery of work until past due balances are paid. All materials or property belonging to the CLIENT, as well as work performed, may be retained as security until all just claims against the CLIENT are satisfied. The CLIENT is responsible for any debt collection, legal or court fees which may come due. In the event of cancellation of the project prior to completion, the CLIENT will be liable for 1 month’s payment as per the 30-day cancellation notice.
  • The Blogs we write are for SEO purposes and include selected keywords and links. If you want to make any editorial changes this will be done at an additional cost.
  • Social media posts are directed at your targeted audience and mostly scheduled in advance. If you need specific posts, please supply the content. Changes to content The Marketing Company created for posts are allowed at an additional cost.
  • Changes to this Policy – The Marketing Company reserves the right to change this policy at any time. Please check this page periodically for changes. Your continued use of our site following the posting of changes to these Terms & Conditions will mean you accept those changes. Information collected prior to the time any change is posted will be used according to the rules and laws that applied at the time the information was collected.
